Terms of Service for Phenohunt

1) Introduction & Acceptance

These Terms of Service (the “Terms”) are a legally binding agreement between you and Soco Supply, LLC (“Company,” “we,” “us,” “our”), governing your access to and use of the Phenohunt mobile application and related websites and services (collectively, the “Service”). By downloading, installing, creating an account, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2) Description of the Service

Phenohunt is software for record‑keeping and educational purposes that allows users to track and manage phenohunts and cultivation‑related data, including notes, ratings, photos, and QR plant tags, and to sync such data across devices. The Service does not buy, sell, broker, ship, or otherwise transact in plant material or products.

Subject to these Terms, we grant you a limited, revocable, non‑exclusive, non‑transferable, non‑sublicensable license to install and use the App on devices you own or control, for personal, non‑commercial use.

The Service may integrate with third‑party services (e.g., authentication, storage, analytics). Your use of those services is governed by their terms and privacy policies. We are not responsible for third‑party services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR CROP FAILURE), ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You will defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

14) Service Changes; Suspension

We may modify or discontinue all or part of the Service, or suspend or restrict access, at any time where necessary for security, legal, or operational reasons. If we discontinue a paid feature, we will provide appropriate notice and, where applicable, a prorated refund consistent with platform policies.

These Terms and any dispute or claim arising out of or relating to them or the Service are governed by the laws of the State of California, without regard to conflicts‑of‑law rules. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Sonoma County, California.

17) Export & Sanctions Compliance

You represent that you are not located in, under the control of, or a national or resident of any country or person on any U.S. government sanctions list. You agree to comply with all applicable export control and sanctions laws.

18) IP Complaints / DMCA

If you believe content available through the Service infringes your intellectual‑property rights, contact support@phenohunt.com with: (a) identification of the work claimed to be infringed; (b) identification of the material claimed to be infringing; (c) your contact information; and (d) a statement that you have a good‑faith belief the use is not authorized and that the information provided is accurate.

Your use of the Service is subject to our Privacy Policy, which is incorporated by reference.

20) Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice (e.g., in‑app or by email). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
